They argue that giving in to ransomware demands is guided by a series of “mistaken beliefs” when it comes to British law. The most damaging of these beliefs is that paying up: … A. protects stolen data. B. results in a lower ICO fine. Paying up guarantees neither of these things. ICO fines in the event of a data breach are calculated based on an organisation's risk mitigation. This includes steps taken to understand what happened, learn from it, report it to relevant authorities and implement future protections. Paying up is not included in this list.
